GENERAL TERMS AND CONDITIONS
1. SCOPE LARIX
ventures Sagl (hereinafter referred to as "larix.shop") operates the website larix.shop, which connects consumers to producers via an online shop/marketplace. The General Terms and Conditions (hereinafter referred to as "GTCs") apply to all orders placed via larix.shop and all contracts concluded (hereinafter referred to as "orders"). The GTCs apply in the version that is currently available and valid when the website is accessed or when goods are ordered. The GTCs, the terms of delivery and payment and the data protection provisions may be changed from time to time. Larix.shop asks you to read these provisions carefully each time you visit the website and order goods. These terms and conditions apply exclusively. Conflicting, supplementary or deviating terms and conditions must be expressly confirmed in writing by larix.shop to be valid. By using this website or ordering goods, the customer confirms that he/she accepts these GTCs including delivery and payment conditions in full. Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
2. OFFERS
A customer is either a natural person or a legal entity domiciled in Switzerland or Liechtenstein. Larix.shop delivers only to addresses in Switzerland or Liechtenstein. Offers are valid as long as they can be accessed on the online shop and only for products, which are not out of stock. The images used on the online shop, and all information about the products offered (product descriptions, illustrations, films, dimensions, weights, product content and nutritional values, technical specifications, accessory relations and other information) are to be understood as non-binding approximate values only and do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Only the specific information displayed with the product (provided on the packaging or separately by the producers) shall apply. Larix.shop makes every effort to ensure that all data and information on this website is correct, complete, up-to-date and clearly arranged, but larix.shop cannot guarantee this either explicitly or implicitly.
Subscriptions: we reserve the right to cancel your subscription at any time for any reason, including but not limited to violation of our terms of service, non-payment, or if we decide to discontinue this particular type of subscription for business reasons. If we cancel your subscription, we will provide you with a prorated refund for any remaining subscription period. We reserve the right to change our subscriptions prices and offers with a notice period of 1 month.
3. PRICES
On larix.shop all prices are displayed in CHF (Swiss Francs) and include value added tax (VAT), unless explicitly stated otherwise. We reserve the right to make price changes at any time and without prior notice in case of technical changes, errors and misprints. Unless otherwise provided, any shipping costs will be charged additionally and are to be paid by the customer. Shipping costs are shown separately in the order process.
4. CONCLUSION OF CONTRACT
The products list on the website constitute exclusively a non-binding online catalogue. Larix.shop reserves the right to limit and to set a minimum amount to delivery quantities of specific products. According to the legal regulations, alcoholic beverages may not be sold in Switzerland to minors under 18 years of age. By placing an order on www.larix.shop the customer acknowledges these regulations and confirms that he is entitled to purchase. Larix.shop declines all liability in the event of infringement. The placement of an order represents an offer to conclude a contract with larix.shop When an order is placed a confirmation and a documenting receipt of the order is automatically sent to the client. After the receiving the order confirmation the contract is concluded and the customer cannot change or cancel the order, unless explicitly agreed by larix.shop. Larix.shop may reject an order, either in its entirety or in part, without stating the grounds. In such cases, larix.shop will inform its customers accordingly and refund any payments already made. Out of stock products cannot be pre-ordered. 5. PAYMENT The customer has the payment options indicated in the checkout process. Larix.shop reserves the right to exclude customers from individual payment options without giving reasons. Unless explicitly agreed with larix.shop (in written form), larix.shop accepts exclusively advance payments via credit cards (Visa, Mastercard), debit card (PostFinance Card) or by Twint.
6. ORDERS PROCESSING AND SHIPMENT
Each order is processed and transferred immediately to each producer. Orders are generally shipped 3 working days after the order date. Larix.shop declines all liability if the order is not ready for shipment in the aforementioned time frame. Deliveries are sent by courier service to the address indicated by the customer in the order. Invoicing is done by email. With the dispatch, benefit and risk are transferred to the customer, as far as this is legally permissible. If the delivery cannot be delivered, or if the customer refuses to accept the delivery, larix.shop may, after notifying the customer of a complaint by email and setting a reasonable deadline, dissolve the contract and charge the customer for the costs of the work involved. The customer is obliged to check the delivered goods immediately after receipt of the delivery and to notify larix.shop of any defects for which larix.shop provides a warranty immediately in writing by email to the address in the imprint. The delivery area covers the whole of Switzerland and Liechtenstein. The delivery takes place within 1-4 working days. Larix.shop does not assume liability for consequential damages due to delay in delivery. Delivery cost of CHF 11.- are charged for each producer as presented in the cart and at checkout. If the value of the products from one producer exceed 150 CHF, the shipping for those products is free of any charge
7. WARRANTY
Larix.shop endeavours to deliver goods in perfect quality. Larix.shop guarantees the quality and shelf-life of its products under the following conditions:
- Non-refrigerated food products have to be stored in a cool, dry place.
- Upon delivery refrigerated foods have to be unpacked and stored at maximum of 5°C
If the aforementioned conditions are met, larix.shop guarantees that delivered products will meet the relevant standards until the relevant best-before date or for a period of two (2) years from the delivery date for products that do not bear a best-before date. In the event of defects notified in good time, larix.shop shall assume the warranty for the absence of defects and functionality of the item purchased by the customer during the statutory warranty period of generally two years from the date of delivery. Larix.shop can fulfil its guarantee through either partial or complete replacement by an equivalent product, a reduction in price or by issuing a credit note up to the sales price applicable at the time of the order. Normal wear and tear and the consequences of improper treatment or damage by the customer or third parties, as well as defects attributable to external circumstances, are not covered by the warranty. Larix.shop is not able to give any assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other contents. In particular, it is neither assured nor guaranteed that the use of the website does not infringe the rights of third parties who are not in possession of larix.shop.
8. LIABILITY
Larix.shop excludes all liability, regardless of its legal basis, as well as claims for damages against larix.shop and any auxiliary persons and agents. Larix.shop is in particular not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage or pure financial loss of the customer. We reserve the right to further mandatory legal liability, for example for gross negligence or unlawful intent.
9. DATA PROTECTION
Larix.shop may process and use the data recorded within the scope of the conclusion of the contract to fulfil the obligations arising from the purchase contract and may also use the data for marketing purposes. The data necessary for the performance of services may also be passed on to commissioned service partners (logistics partners) or other third parties. 10. APPLICABLE LAW AND JURISDICTION
These terms and conditions can be changed at any time and without prior notice. These GTCs and the contracts concluded on the basis of these GTCs are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
